1. Who we are
GSM Vortex ("the Service") is provided by GSM Solutions, [legal name, address, registration number, tax ID], Serbia ("we", "us"). Contact: support@gsm.rs.
2. The Service
GSM Vortex is an AI chat assistant for WordPress websites, consisting of a WordPress plugin and our online service (hub). The assistant answers visitors using your site's content and an AI provider account that you connect and pay for yourself.
3. Account and domains
You must give a valid email address and only add domains you own or are authorized to manage. Each plan allows a set number of domains. You are responsible for activity under your account and for keeping your password and site keys secret.
4. Free trial
New customers may use one free 30-day trial for one domain. A domain and an email address can each be used for a free trial only once. No payment details are required and nothing is charged automatically when the trial ends.
5. Subscriptions and payment
Paid plans are billed monthly or yearly in advance. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices are shown in USD; taxes are added where required. The Paddle Buyer Terms also apply to your purchase. We do not offer refunds beyond the Refund Policy, which explains when Paddle may refund and the statutory rights of consumers.
If a renewal payment fails, we will remind you and the Service keeps working for 7 days. After that the chat is hidden from your website visitors until payment succeeds. If the account stays unpaid, your data is deleted 90 days later; we notify you by email before deletion.
6. Availability
The chat on your website runs through our hub. We target 99.9% monthly availability, excluding announced maintenance. If the Service is unavailable for longer, we may extend your plan free of charge at our discretion (service credit); we notify you by email.
6a. Cancellation
You can cancel at any time in your dashboard. Your plan stays active until the end of the period you have paid for and is not renewed.
7. Your AI provider
You connect your own account with an AI provider (e.g. Google, OpenAI, Anthropic) and accept that provider's terms and charges. We are not responsible for the provider's availability, costs or the content it generates.
8. Acceptable use
You may not use the Service for unlawful content, spam, to attack other systems, or to circumvent limits, the trial rules or licensing. We may suspend accounts that break these terms.
8a. Misuse and closing an account
Misuse includes in particular: using one free trial more than once (also through other emails or accounts), sharing one subscription between several websites or accounts, using a site key on a domain that is not registered, modifying the plugin or bypassing its connection to our service, systematically copying or reproducing the dashboard, the Service or how it works, disputing a valid payment with the bank, and automated or unauthorized requests to our systems.
To protect the Service we watch for such signs with automated security checks. When we find misuse, we may block the account at once, cancel all its subscriptions and switch the chat off on all its domains. We tell you the reasons by email. We are not obliged to accept a new account from the same person or company.
In that case we may, at our sole discretion, refund the last payment fully or partly through Paddle; there is no right to a refund for an account closed because of misuse. Refunds otherwise follow the Refund Policy.
9. AI answers
AI answers can be inaccurate. The Service includes safeguards, but you remain responsible for your site's content, prices and the information given to your customers.
10. Intellectual property
The Service, the plugin and our brand remain our property. You receive a non-exclusive, non-transferable right to use them during your subscription. Your content and your data remain yours.
11. Liability
The Service is provided "as is". To the extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim.
12. Changes
We may update these terms; material changes are announced by email at least 14 days in advance.
13. Law
These terms are governed by the laws of the Republic of Serbia, without prejudice to mandatory consumer protection rules of your country.
